Welcome to NFC Cards South Africa
Welcome to NFC Cards South Africa (“the Site” or “NFC Cards SA”), a division of ProfileMe (Pty) Ltd (Registration number: 2019/207663/07). We provide professional NFC business cards, NFC phone tags, custom branded NFC products, and optional digital business card services to help you network smarter and share your details instantly.
By purchasing our products or using the Services in any way, you (“user”, “Customer”) accept these Terms of Service and acknowledge that you have read and understood our Privacy Policy — both of which form a binding legal agreement between you and us.
You must be an adult — 18 years or older — and capable of lawfully entering into this Agreement.
If you do not accept and agree to be bound by all of the terms of this Agreement — including our Privacy Policy, limitations of liability, and warranty disclaimers — do not purchase our products or use the Services.

Products & Services
1.1 — NFC Hardware Products
NFC Cards South Africa sells the following physical NFC hardware products:
NFC Business Cards
Custom branded with your logo the flagship product for professional networking.
NFC Phone Tags
Generic or custom-branded phone tags stick to the back of your phone and tap to share.
Custom Branded NFC Tags
Bulk orders (minimum 10 units) ideal for teams, events, and corporate rollouts.
All NFC Products include a free vCard (digital contact file) pre-programmed to work standalone without any subscription or account. You are not required to subscribe to any digital service to use the NFC hardware.1.2 — Digital Business Card Service (Optional)
In addition to NFC hardware, we offer an optional Digital Business Card subscription at R49/month. The Digital Service is entirely optional — you may purchase NFC Products without subscribing.

1.3 — Product Descriptions and Samples

Ordering & Payment
2.1 — Product Orders
When you place an order, you are making an offer to purchase at the stated price. We reserve the right to accept or reject any order. An order confirmation email is an acknowledgment only — acceptance occurs when we dispatch your NFC Products for delivery.
All payments must be made at time of order placement unless otherwise agreed in writing. Accepted methods: credit card, debit card, EFT, and others as displayed on the Site.
2.2 — Custom Branding Orders
For custom branded NFC cards or bulk custom tags, you must upload your logo or branding files during checkout. You warrant that:
- You own all intellectual property rights in the logo and branding materials, or have all necessary licenses and permissions.
- Your materials do not infringe on the intellectual property rights of any third party.
- Your materials do not contain any illegal, offensive, or defamatory content.
Our design team will review your custom branding within 1 business day and will contact you if there are any file quality or format issues. Production will not commence until branding approval is complete.2.3 — Digital Business Card Subscription
Subscription billing begins on the date you activate your Digital Business Card account. Renewals occur automatically on the same date each month unless you cancel prior to the renewal date.

- Cancellations take effect at end of the current billing period
- No partial refunds for mid-month cancellations
- No charge for subsequent months after cancellation

Refund & Return Policy
3.1 — NFC Hardware Products (Physical Goods)
All sales of NFC hardware products are final once shipped. We do not offer refunds or exchanges except in the following circumstances:
Defective Products
If your NFC card or tag is defective (chip does not function, severely flawed print quality, or damaged on arrival), we will replace it at no cost. Report within 7 days with photographic evidence.
Shipping Errors
If we shipped the wrong product or incorrect quantity, we will correct the error at no cost. Report within 7 days of delivery.
Custom Branding Errors
If we made an error printing your custom branding (wrong logo, colors, or misalignment), we will reprint at no cost. Report within 7 days with proof the error was ours.
We do not accept returns for change of mind, buyer’s remorse, or dissatisfaction with appearance (unless due to a defect or our error). Custom branded products cannot be returned or refunded as they are produced specifically for you.3.2 — Digital Business Card Subscription
30-Day Money-Back Guarantee
First-time Digital Business Card subscribers may request a full refund within the first 30 days of their initial subscription if not satisfied. Contact hello@nfccardsouthafrica.co.za to request.
After the 30-Day Period
- No refunds for Digital Business Card subscriptions after 30 days
- You may cancel at any time — cancellation takes effect at end of billing period
- Subscription renewals are not eligible for refunds
- Cancel before renewal date to avoid future charges
3.3 — How to Request a Refund or Replacement

Shipping & Delivery
We ship NFC Products to addresses within South Africa only. International shipping is not currently available.

You are responsible for providing an accurate and complete delivery address. We are not liable for failed deliveries or lost parcels caused by incorrect addresses.
Delivery times are estimates and may vary due to courier availability, public holidays, or force majeure events (natural disasters, strikes, pandemics). We are not liable for third-party courier delays.
Risk of loss and title for NFC products pass to you upon delivery to the carrier. For full shipping terms, visit nfccardsouthafrica.co.za/shipping.
Section 05
User Accounts & Registration
You do not need an account to purchase NFC hardware products. However, a Digital Business Card subscription requires account creation.
Registration is restricted to a single account per individual or company.
Duplicate accounts may be removed without notice.
All information submitted during registration must be
correct, accurate, and complete and must not violate the rights of third parties.
You are responsible for maintaining the confidentiality
of your account login credentials (username and password).
Notify us immediately of any unauthorized use of your account or any other security breach.
We reserve the right to suspend or terminate your account
at any time if you have violated this Agreement, engaged in fraudulent activity,
or misused the Services.
Section 06
Intellectual Property
Our Intellectual Property
ProfileMe (Pty) Ltd owns and retains all proprietary rights in the Site, the Services, and all related content, trademarks, trade names, and logos. Our trademarks may not be used without our express prior written consent.
Your Content & Custom Branding
You retain ownership of your uploaded content. However, you grant us a limited, non-exclusive, royalty-free license to use your content solely for producing your NFC products, hosting your digital profile, and providing support.
Copyright Compliance
You are solely responsible for ensuring you have the copyright or necessary licenses for all materials you supply. If we receive a cease and desist notice related to your content, we will remove it immediately and you may be billed for associated costs.
If we are informed that material you provided was used without required copyright permissions, we will remove the content immediately and may suspend or terminate your account. You will be liable for any costs, damages, or legal fees incurred.

Prohibited Uses
Illegal or Harmful Content
Using NFC Products or Services to distribute illegal, harmful, defamatory, obscene, or otherwise objectionable content.
Malicious Code
Uploading or transmitting viruses, malware, or any other malicious code that could harm our systems or devices of other users.
Unauthorized Access
Attempting to gain unauthorized access to our systems, servers, or databases, or interfering with the proper functioning of the Site or Services.
Automated Systems
Using bots, scripts, or scrapers to access the Site or Services without our prior written consent.
Fraudulent Activity
Engaging in fraudulent activity including using stolen credit cards, creating fake accounts, or placing fraudulent orders.
Unauthorized Reselling
Reselling, redistributing, or commercially exploiting NFC Products or Services without our prior written consent.
We reserve the right to suspend or terminate your access immediately if we determine that you have engaged in any prohibited activity.

Disclaimers & Warranties
8.1 — General Disclaimer
WE PROVIDE THE SERVICES AND NFC PRODUCTS ON AN “AS IS” AND “AS AVAILABLE” BASIS. YOUR USE OF THE SERVICES AND PRODUCTS IS AT YOUR OWN RISK. WE EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
- No warranty that NFC Products or Services are suitable for your specific needs.
- No warranty that NFC technology will work on all devices (compatibility depends on recipient’s device).
- No warranty that the Services will be uninterrupted, error-free, or free from bugs.
- No warranty that any particular feature of the Services will be supported indefinitely.
- No warranty regarding accuracy of user-generated content (e.g., digital profiles created by other users).
8.2 — NFC Product Warranty
We warrant that NFC Products will function as described at the time of delivery (i.e., the NFC chip will transmit data when tapped on a compatible device). NFC chips have no battery and no moving parts, but can be damaged by:
If your NFC Product is defective upon arrival, we will replace it at no cost — provided you report within 7 days of delivery. We are not responsible for damage caused by misuse, abuse, or normal wear and tear after delivery.
8.3 — Third-Party Services and Links
The Site and Digital Service may contain links to third-party websites (e.g., LinkedIn, Instagram, WhatsApp, Calendly). We are not responsible for the availability, accuracy, or content of third-party websites, nor for any services delivered by affiliates or third-party providers not under our direct control.
Section 09
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
(I) IN NO EVENT SHALL PROFILEME (PTY) LTD, NOR ITS AFFILIATES, SUPPLIERS, EMPLOYEES, DIRECTORS, OR AGENTS, BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES — INCLUDING LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL LOSSES — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES OR PRODUCTS.
(II) PROFILEME (PTY) LTD’S TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO PROFILEME (PTY) LTD OVER THE THREE (3) MONTHS PRECEDING YOUR CLAIM(S).
If you do not accept this limitation of liability, you are not authorized to purchase NFC Products or use the Services. Some jurisdictions do not allow exclusion of certain liabilities — in such cases, our liability is limited to the fullest extent permitted by law.
Section 10
Indemnification
You agree to indemnify, defend, and hold harmless ProfileMe (Pty) Ltd, its directors, officers, employees, affiliates, agents, successors, and assigns from and against any claim, demand, loss, damage, cost, or expense (including reasonable attorneys’ fees) arising out of or in connection with:
- Your use of the Site, Services, or NFC Products.
- Your violation of this Agreement or any applicable law or regulation.
- Your violation of any rights of another person or entity, including intellectual property rights, privacy rights, or defamation claims.
- Any content you upload, submit, or transmit using the Services (including custom branding, digital profiles, or lead capture forms).
- Any fraudulent, illegal, or unauthorized activity conducted through your account or using your NFC Products.
Section 11
Privacy
All information collected about you during registration, product orders, and use of the Services will be used in accordance with our Privacy Policy and all applicable laws, including POPIA and GDPR.
By using the Site and Services, you consent to the collection, use, and storage of your personal information as described in our Privacy Policy, available at nfccardsouthafrica.co.za/privacy-policy.
Section 12
Modifications to Terms & Services
We reserve the right, at our sole discretion, to alter, replace, or otherwise modify these Terms, our Privacy Policy, or the Services at any time. Changes are effective upon posting of the revised Terms on the Site.
- Continued use of the Site or Services after changes are posted means you accept those changes.
- If you do not agree with modified Terms, you must stop using the Site and Services immediately.
- We may modify, suspend, or discontinue any part of the Services at any time without prior notice.
- We reserve the right to disable, suspend, or terminate any user’s access for any reason without notice or liability.
Section 13
Termination
This Agreement remains in effect until terminated by either you or us.
You May Terminate By:
- Ceasing to use the Site and Services.
- Canceling your Digital Business Card subscription (if applicable) and closing your account.
We May Terminate For:
- Breach of this Agreement.
- Suspected fraudulent activity or abuse.
- Non-payment of subscription fees or outstanding invoices.
- Violation of applicable laws or regulations.
Upon Termination of Your Account or Subscription:
- Your access to the Digital Business Card service will cease immediately.
- Your digital business card profile will be deactivated (the link will no longer work).
- Your profile data will be deleted or anonymised within 30 days, per our Privacy Policy.
- NFC hardware products you have purchased will continue to function with the free vCard, but advanced digital features will no longer be available.
Termination does not relieve you of any obligations incurred prior to termination, including payment obligations.
Section 14
Dispute Resolution, Jurisdiction & Governing Law
Governing Law
This Agreement and any dispute shall be governed by the laws of the Republic of South Africa without regard to principles of conflicts of law.
Jurisdiction
You submit to the exclusive jurisdiction of the courts located in Pretoria, Gauteng, South Africa for the resolution of any disputes arising out of or related to this Agreement.
Time Limitation on Claims
Any claim or cause of action must be filed within one (1) year after such claim or cause of action arose, or be forever barred.
No Partnership or Agency
No joint venture, partnership, employment, or agency relationship exists between you and ProfileMe (Pty) Ltd as a result of this Agreement or use of the Services.
Section 15
General Provisions
- No Waiver:Our failure to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.
- Severability:If any provision is found invalid or unenforceable by a court, the remaining provisions of this Agreement remain in full force and effect.
- Entire Agreement:This Agreement constitutes the entire agreement between you and ProfileMe (Pty) Ltd regarding the use of the Site, Services, and NFC Products, superseding all prior communications and representations.
- Modifications:This Agreement may not be modified except by a revised Agreement posted by ProfileMe (Pty) Ltd on the Site, or a written amendment signed by an authorized representative.
- Headings:Section titles in this Agreement are for convenience only and have no legal or contractual effect.
